Terms of Service

These Terms of Service ("Terms") govern your use of the BulkPublish website at bulkpublish.com and the application at app.bulkpublish.com (collectively, the "Service"), operated by BulkPublish ("we", "us", "our"), a product of BROWSE (SMC-PRIVATE) LIMITED, a private limited company registered in the Islamic Republic of Pakistan. By creating an account or using the Service, you agree to be bound by these Terms.

1. Account Registration

To use the Service, you must create an account with a valid email address or sign in via Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 16 years old to use the Service.

You agree to provide accurate and complete information when creating your account, and to update it promptly if it changes.

2. Description of Service

BulkPublish is a social media scheduling and publishing platform. The Service allows you to compose content and publish or schedule it to connected social media platforms, including Facebook, Instagram, TikTok, YouTube, X (Twitter), Threads, Bluesky, Pinterest, LinkedIn, Google Business Profile, and Mastodon.

We provide the tools to create and schedule posts. We do not guarantee that content will be successfully delivered to any third-party platform, as publishing depends on those platforms' APIs, terms, and availability.

3. Plans and Billing

3.1 Free and Paid Plans

The Service offers a free tier with limited features and paid subscription plans (Pro and Business) with expanded capabilities. Details of each plan's limits are available on our Pricing page.

3.2 Payment

Paid subscriptions are billed through our payment provider, Polar. By subscribing to a paid plan, you agree to Polar's terms and authorize recurring charges at the interval you selected (monthly or yearly).

3.3 Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, your paid features remain active until the end of the current billing period. We do not provide prorated refunds for partial billing periods. After the billing period ends, your account will revert to the free tier.

3.4 Plan Changes

We reserve the right to modify pricing and plan features with reasonable notice. Existing subscribers will be notified of any changes before they take effect.

4. Your Content

4.1 Ownership

You retain full ownership of all content (text, images, videos) that you create or upload through the Service. We do not claim any intellectual property rights over your content.

4.2 License to Us

By uploading content to the Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of operating the Service, including publishing content to the social media platforms you have connected.

4.3 Content Responsibility

You are solely responsible for the content you publish through the Service. You represent that you have the necessary rights to all content you upload and that your content does not violate any applicable laws or third-party rights.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right
• Publish spam, misleading, or deceptive content
• Distribute malware, viruses, or other harmful code
• Infringe on intellectual property rights of others
• Harass, abuse, threaten, or incite violence against any person or group
• Distribute sexually explicit material involving minors
• Attempt to gain unauthorized access to other users' accounts or our systems
• Circumvent usage limits, rate limits, or other restrictions of the Service
• Resell, sublicense, or white-label the Service without our written consent
• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate your account if you violate these terms.

6. API Access

All plans include access to the BulkPublish API. API usage is subject to rate limits and quotas defined by your plan (e.g., number of API keys, posts per day, storage). You agree not to use the API in a manner that degrades the Service for other users. We may revoke API access if you violate these Terms or exceed usage limits.

7. Connected Platforms

The Service integrates with third-party social media platforms. Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for changes to third-party APIs, terms, or availability that may affect the Service's ability to publish content.

You may disconnect any social media account from the Service at any time. Upon disconnection, we will delete the stored access tokens for that account.

8. Team and Organization Features

The Service supports multiple team members within an organization. Organization owners are responsible for the actions of their team members. Access levels and permissions are managed by the organization owner or administrators.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, during which the Service may be temporarily unavailable. We are not liable for any downtime, data loss, or missed scheduled posts caused by technical issues, third-party platform outages, or circumstances beyond our control.

10. Intellectual Property

The Service, including its design, code, features, and branding, is owned by BulkPublish and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

11. Limitation of Liability

To the maximum extent permitted by law, BulkPublish shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of your use of the Service.

Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, be available at any particular time, or operate without errors.

13. Indemnification

You agree to indemnify, defend, and hold harmless BulkPublish and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

14. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. We may delete your data within 30 days of termination.

You may delete your account at any time from your account settings.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law

BulkPublish is operated from Pakistan. These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
